185 Improper witnessing of consent
A person who subscribes his or her name as a witness to the signature of a person to an instrument of consent to the adoption of a child without—
being satisfied that the person signing the instrument is a parent of, or person who has parental responsibility for, the child, and
being satisfied that the person signing the instrument is doing so free from any threat, inducement or influence of a kind referred to in section 184, and
taking such steps as are prescribed by the regulations to satisfy himself or herself that the person signing the instrument understands the effect of the consent, and
being satisfied that the instrument bears the date on which it is signed by the person giving the consent,
is guilty of an offence.
Maximum penalty—25 penalty units or imprisonment for 12 months, or both.
