Biodiversity Conservation Act 2016

Proceedings for an offence against this Act or the regulations, or for a native vegetation offence, may be dealt with summarily before the Local Court or before the Land and Environment Court in its summary jurisdiction.

If proceedings for an offence are brought in the Local Court, the maximum monetary penalty that the Local Court may impose for the offence is, despite any other provision of this Act, $110,000 (including within that maximum amount any additional daily penalty or any additional penalty for each animal or plant affected by the offence) or the maximum monetary penalty provided for the offence, whichever is the lesser.
