Building and Development Certifiers Act 2018

It is a condition of registration that a registered certifier must not carry out certification work for a person unless the work is carried out under a written contract between—

the person and a council, if the person has appointed the council to carry out the certification work, or

the person and the registered certifier or the employer of the registered certifier, in any other case.

A contract under this section must comply with any requirements prescribed by the regulations.

Without limiting subsection (2), the regulations may make provision for or with respect to the following—

requiring contracts to contain provisions to the effect of those prescribed by the regulations,

providing that contracts must not contain provisions to the effect of those prescribed by the regulations,

requiring specified particulars or information to be included in contracts or to accompany contracts, for example, an information document published by the Secretary or another person or body,

the time or times at which fees and charges under contracts are to be paid.
