72 Exemption power—Cemeteries Agency
The Cemeteries Agency may, by order in writing, exempt a Crown cemetery operator or class of Crown cemetery operators, or an operator member or class of operator members, from the operation of this Part or a specified provision of this Part if—
it considers that they have duties or obligations under the provisions of another Act, or a regulation, that are commensurate with the duties or obligations under this Part or the provision concerned, or
taking into account the scale and nature of operations of the cemetery concerned, it considers it appropriate to do so.
The exemption may be limited in duration or may be subject to such factors or circumstances as may be specified in the order.
