29 Other referral of complaints to Tribunal
This section applies if the President—
considers that a complaint cannot be resolved by conciliation, or
has tried to resolve a complaint by conciliation but has not been successful, or
considers that, because of the nature of a complaint, the complaint should be referred to the Tribunal, or
is satisfied that all parties wish the complaint to be referred to the Tribunal and it is appropriate in the circumstances to make the referral.
The President must, with the complainant’s consent, refer the complaint to the Tribunal.
Note—
The President may also refer a complaint to the Tribunal under section 17(6).
