Samples—sufficient material to share

(1)

This section applies to a sample taken from a suspect under this Act if there is sufficient material to be analysed both in the investigation of the offence and on behalf of the suspect.

(2)

The investigating police officer concerned must ensure that—

(a)

a part of the material sufficient for analysis is made available to the suspect as soon as practicable after the procedure has been carried out, and

(b)

reasonable care is taken to ensure that the suspect’s part of the material is protected and preserved until the suspect receives it, and

(c)

reasonable assistance is given to the suspect to ensure that the material is protected and preserved until it can be analysed.

Note.

Part 13 contains provisions about making material available to the suspect.
