Power to enter premises
27 Power to enter premises
An authorised officer may enter any premises.
The authorised officer may enter the premises with such assistants (including police officers) as may reasonably be required. In the case of premises comprising a mine or petroleum site within the meaning of the Work Health and Safety (Mines and Petroleum Sites) Act 2013, the authorised officer may be accompanied by a person nominated by the regulator within the meaning of that Act.
The authorised officer must notify the occupier of the premises before entering the premises unless—
the entry is made with the permission of the occupier, or
the entry is made to a part of the premises open to the public, or
notifying the occupier would defeat the purpose for which the premises were entered or would unreasonably delay the authorised officer in a case of urgency.
Entry under the power conferred by this section may only be made at a reasonable time. This subsection does not apply to a power conferred by a search warrant.
The powers of entry conferred by this Part are not exercisable in relation to any part of premises used only for residential purposes except—
with the permission of the occupier of the premises, or
under the authority conferred by a search warrant.
