Duties Act 1997

An application to bring land under the Real Property Act 1900 is chargeable with—

the same duty as on a possessory application under that Act if—

the application contains an application based on possessory title, and

the applicant has not paid ad valorem duty under this Chapter on a transfer of the land, or

the same duty as on a transfer of the land if the applicant nominates another person as the person for whose estate or interest a folio of the Register is to be created, or

duty of $100 in any other case.

The person liable to pay the duty is—

the applicant, if subsection (1) (a) or (c) applies, or

the nominee, if subsection (1) (b) applies.
