Insert after section 61(4)—
(5)
Subsection (3) and sections 2AB(2), 60 and 69 apply, for the purposes of subsection (1A), with the following modifications—
(a)
a reference to the AER is taken to be a reference to the IPART;
(b)
a reference to the Commonwealth is taken to be a reference to the State of New South Wales.
(6)
In this section—
IPART means the Independent Pricing and Regulatory Tribunal established by section 5(1) of the Independent Pricing and Regulatory Tribunal Act 1992 of New South Wales.
