Powers of and procedure before a Committee
111 Powers of and procedure before a Committee
(cf PH Act s 33N)
A Committee has, for the purposes of the appeal, the powers, authorities, protections and immunities conferred by the Royal Commissions Act 1923 on a commissioner and the chairperson of a commission respectively, appointed under Division 1 of Part 2 of that Act. That Act (Division 2 of Part 2 excepted) applies to any witness summoned by or appearing before a Committee in the same way as it applies to any witness summoned by or appearing before a commission.
The decision of the Chairperson of the Committee on any question of law or procedure that may arise before a Committee is taken to be the decision of the Committee.
Except as provided by subsection (2), a decision supported by a majority of the Committee is the decision of the Committee.
If 2 members support a proposed decision and 2 members oppose the proposed decision, the Chairperson has a second or casting vote.
