45 Provision consequent on enactment of Coal Mine Health and Safety Act 2002
In relation to a decision in proceedings for an offence under the Occupational Health and Safety Act 1983 or the regulations under that Act—
(a)
section 197A of this Act does not apply to a decision made before the commencement of Schedule 2.9 to the Coal Mine Health and Safety Act 2002 (which substituted section 197A (10)), and
(b)
section 197A extends to proceedings commenced before the commencement of Schedule 2.9 to the Coal Mine Health and Safety Act 2002.
