Anything done or omitted to be done by any person—
(a)
in the exercise of functions under this Act, the regulations or a Ministerial order (including functions which, by this Act, are taken to be functions under another Act or instrument), or
(b)
pursuant to any of the provisions of this Act, the regulations or a Ministerial order (including provisions which, by this Act, are taken to be provisions of another Act or instrument),
does not constitute a nuisance.
