Mining Act 1992

The regulator may enter into an arrangement (an information sharing arrangement) with a relevant agency for the purposes of sharing or exchanging any information that is held by the regulator or the agency.

The information to which an information sharing arrangement may relate is limited to information that assists the regulator or relevant agency—

to determine applications made under the resources legislation or legislation made under the corresponding law of another jurisdiction, or

to determine whether to cancel, revoke or vary an authorisation that is granted, made or given under that legislation, or

to determine whether to suspend a condition of, or operations under, an authorisation that is granted, made or given under that legislation, or

to determine whether to cancel, revoke, suspend or vary an activity approval or other approval, or an exemption or declaration, that is granted, made or given under that legislation, or

to determine whether to make a decision under Part 18, Division 2, or

to facilitate the carrying out of inspections, probity checks or other enforcement action under that legislation.

Under an information sharing arrangement, the regulator and the relevant agency are, despite any other Act or law of the State, authorised—

to request and receive information that is held by the other party to the arrangement, and

to disclose that information to the other party.

In this section—

regulator means the Minister or the Secretary.

relevant agency means any of the following—

a government agency or holder of a statutory office with any functions similar to or related to those imposed on the regulator by or under the resources legislation,

any government agency of the Commonwealth or another State or Territory with functions similar to or related to those imposed on the regulator under any of the resources legislation,

any other person or body, or person or body of a class, prescribed by the regulations.
