175 Proceedings on a review
The Commission is to commence hearing an application for a review under this Division within 4 weeks after the application is made.
The applicant has at all times the burden of establishing that the order to which the application relates is beyond power or is harsh, unreasonable or unjust. This subsection has effect despite any law or practice to the contrary.
In determining the applicant’s claim, the Commission may take into account such matters as it considers relevant.
Without limiting the matters to which the Commission is otherwise required or permitted to have regard in making its decision, the Commission must have regard to—
the interests of the applicant, and
the public interest (which is taken to include the fact that the Commissioner made the order pursuant to section 173).
