4B Exempt agencies must refer certain disclosures—the Act, s 63
If an exempt agency receives a disclosure of a kind specified in the Act, section 49(1), the exempt agency must, as soon as reasonably practicable, refer the disclosure to one of the following—
a disclosure officer for an agency associated with the public official making the disclosure,
a disclosure officer for an agency which employs government sector employees to enable the exempt agency to exercise the exempt agency’s functions,
an integrity agency.
Note—
See the Act, section 20(5) for the circumstances in which a public official is associated with an agency.
The exempt agency must not refer the disclosure unless the exempt agency has considered the risk of detrimental action being taken against the maker of the disclosure as a result of referring, or failing to refer, the disclosure.
