Notice to be sent to holders of interests in land
189 Notice to be sent to holders of interests in land
After the claims of interest have been determined, the Minister must give notice of the decision to continue with the proposed acquisition of the land to—
the applicant, and
each person whose claim of interest has been accepted.
The notice—
must invite the applicant and each such person to agree on the amount of compensation to be paid or otherwise provided in respect of that person’s interest, and
must notify the applicant and each such person that any such agreement does not have effect unless it is approved by the Minister, and
must notify the applicant and each such person that either of them, or the Minister, may apply to the Land and Environment Court for a determination of the amount of compensation to be paid or otherwise provided if an agreement is not made and approved within 12 weeks after service of the notice.
Notice is not required under this section if the applicant and each person whose claim of interest has been accepted have reached agreement on the compensation to be paid or otherwise provided and have lodged the agreement with the Minister for approval.
