38 Election by transferred contributor to take pension benefit
An election by a transferred contributor or the spouse or de facto partner of a transferred contributor to take a pension benefit under this Regulation shall—
be in a form approved by the Board,
be signed by that contributor or spouse or de facto partner, as the case requires,
specify such matters and be accompanied by such information as the Board may require,
specify the proportion of benefit points to be converted to a pension, the proportion being the same for each class of benefit points which may be so converted, and
be lodged at the office of the Board within the period of 3 months (or such extended period as the Board may in special circumstances allow) that immediately follows that contributor’s exit date or, if the case requires, the day on which that contributor died.
The Board is entitled to act on the information provided in accordance with subclause (1).
