109A Surrogacy arrangements
A child of a surrogacy arrangement in respect of whom a parentage order is made is to be regarded, for the purposes of distribution on an intestacy, as a child of the intended parent or parents named in the parentage order and—
the child’s family relationships are to be determined accordingly, and
family relationships that exist as a matter of biological fact, and are not consistent with the relationship created by parentage order, are to be ignored.
In this section, a parentage order means a parentage order, or an Interstate parentage order, within the meaning of the Surrogacy Act 2010.
