Water Industry Competition Act 2006

An order in force under section 51 immediately before the commencement of Schedule 1[19] of the amending Act declaring that a specified licensed retail supplier or licensed network operator is a monopoly supplier in relation to a specified water or sewerage service, a specified area and a specified class of customers is to be taken to be a declaration in force under section 51 as substituted by the amending Act that the specified water or sewerage service provided in the specified area to the specified class of customers is a monopoly service.

A determination of IPART in force immediately before the commencement of Schedule 1[19] of the amending Act that specifies the price a monopoly supplier, as declared under section 51 as then in force, can charge its customers is to be read as specifying the price that may be charged for the water or sewerage service provided in the area to the class of customers specified in the declaration of the monopoly supplier under section 51 as then in force.
