Insurance policies to cover retrospective claims

In force

(1)

A policy of insurance issued or renewed under this Act before the commencement of this section extends (and is to be taken to have always extended) to the employer’s liability independently of this Act for which the employer is required to obtain a policy of insurance under section 155.

(2)

Any liability to which a policy of insurance extends because of this section is also a liability to which any corresponding policy of re-insurance extends.
