49 Appeals to Local Court not commenced or determined before commencement
Subsection (2) applies to a complainant or registered architect if, immediately before the commencement, the complainant or registered architect:
was entitled to appeal to the Local Court against a decision of the Minister under the former appeal provisions; and
had not yet commenced an appeal against the Minister's decision.
The complainant or registered architect may appeal to the Local
Court against the Minister's decision in accordance with the former appeal provisions, as if the amending Act had not commenced.
The Local Court must hear and determine any appeal commenced under subsection (2) in accordance with the former appeal provisions, as if the amending Act had not commenced.
Subsection (5) applies in relation to an appeal to the Local
Court against a decision of the Minister that:
was commenced by a complainant or registered architect under the former appeal provisions before the commencement; and
had not been finally determined by the Local Court before the commencement.
The Local Court must continue to hear and determine the appeal in accordance with the former appeal provisions, as if the amending
Act had not commenced.
In this section:
former appeal provisions means sections 23F to 23H of this Act, as in force immediately before the commencement.
