48A Building work by building contractors
A person must not commence or continue to carry out prescribed building work unless the person is:
a building contractor registered to carry out the building work as specified in the Regulations; or
being supervised by a building contractor mentioned in paragraph
in accordance with the Regulations.
Maximum penalty: 85 penalty units.
It is a defence to a prosecution for an offence against subsection (1) if:
the value of the building work is less than the prescribed amount for the building work; or
the defendant is an owner-builder carrying out building work that the defendant is permitted to carry out under the owner-builder certificate.
For subsection (2)(a), the Regulations may prescribe different amounts for different kinds of prescribed building work.
