Caravan Parks Act 2012

If a resident fails to give to the operator possession of agreement property occupied under a caravan park agreement after the resident is required under this Act to do so, the operator is entitled to receive from the resident:

compensation for any loss or expense incurred by the operator by the failure; and

an amount equivalent to the rent that would have been payable by the resident for the agreement property for the period the resident remains in possession after termination of the agreement.

On application to the Tribunal by the operator under the agreement, the Tribunal may make an order requiring a resident to pay to the operator the amount the Tribunal considers is payable under subsection (1).
