49 Rent in advance
(1)
An operator commits an offence if the operator requires a resident:
(a)
to pay for more than one rental payment period before the end of the first rental payment period of the occupancy; or
(b)
to pay rent before the end of the last rental period for which rent has been paid; or
(c)
to give a post-dated cheque or other post-dated negotiable instrument in payment of rent.
Maximum penalty: 20 penalty units.
(2)
An offence against subsection (1) is an offence of strict liability.
