58 Child related social security benefits
This section applies if the Commissioner consents to a child residing at a custodial correctional facility with a prisoner.
If any social security benefits are payable to the prisoner in relation to the child, the prisoner must:
arrange for the benefits to be paid to the Commissioner instead of the prisoner; or
if a benefit is paid to the prisoner – pay the benefit to the
Commissioner within 30 days of it being received by the prisoner.
If an amount is paid to the Commissioner under subsection (2), the Commissioner must pay the amount into the prisoner's trust account.
If a benefit is not paid to the Commissioner as required by subsection (2)(b), the Commissioner may deduct the amount of that benefit from the prisoner's trust account.
