53 Witnesses' expenses
(1)
Subject to subregulation (2), a person who is summoned by the
Minister as a witness under section 98 of the Act shall be paid the same fees and expenses as that person would be entitled to receive had he or she been summoned as a witness to appear before the Supreme
Court.
(2)
An employee within the meaning of the Public Sector
Employment and Management Act 1993 shall not be entitled to payment under this regulation unless that employee is on leave of absence on the day on which he or she gives evidence.
