14 Duties of persons in charge of plant, &c.
The person in charge of:
(a)
a building or structure, including fixtures and fittings of the building or structure that are under his or her control; or
(b)
plant or a container or vehicle,
used in the handling of dangerous goods must ensure, as far as practicable, that the condition or use of the plant, container, vehicle, building, structure or fixtures or fittings is not likely to endanger the safety or health of a person or to damage any property.
Maximum penalty: In the case of a body corporate – 2 160 penalty units.
In the case of a natural person – 430 penalty units.
