Electoral Act 2004

(1) The

Commission may, at any time before a candidate is declared to be elected, direct an authorised officer for a division to recount any ballot papers placed in a parcel under this Part.

(2) The

Commission may give the direction:

(a) on receipt of a written request by a candidate stating the reasons for it; or

(b) on the Commission's own initiative.

(3) This

Part applies to the recount and any decision made earlier in the scrutiny relating to the admission or rejection of a ballot paper as a formal ballot paper may be reversed.

(4) The officer must, if required by a candidate's scrutineer, refer any question relating to the formal or informal nature of a ballot paper to the Commission.

(5) The

Commission must decide the question.
