Electoral Act 2004

(1) The

Administrator may issue a writ for a general election at any time if:

(a) a motion of no confidence in the Government is passed by the

Legislative Assembly (being a motion of which not less than 3 clear days notice has been given in the Legislative Assembly); and

(b) during the period of no confidence, the Legislative Assembly has not passed a motion of confidence in the Government.

(2) After the motion of no confidence is passed, the Legislative Assembly may not be prorogued before the end of the period of no confidence and may not be adjourned for a period extending beyond that period unless a motion of confidence has been passed.

(3) In this section:

period of no confidence, for a motion of no confidence in the

Government, means the period starting on the day the motion is passed and ending 8 clear days after it is passed.
