252 Question relating to qualification or vacancy
(1) The
Legislative Assembly may, by resolution, refer to the Court of
Disputed Returns, a question relating to:
(a) the qualification of a person to be an MLA; or
(b) a vacancy in the Legislative Assembly.
(2) Immediately after the resolution is passed, the Speaker of the Legislative
Assembly must give the Court:
(a) a copy of the reference certified by the Speaker; and
(b) the documents or other material in the possession of the Legislative
Assembly relating to the reference.
