78 Show cause process
The Minister must not accept a statement of unacceptable impact unless the Minister has first complied with this section.
The Minister must give written notice (a show cause notice) to the proponent:
stating the Minister's intention to accept the statement of unacceptable impact; and
asking the proponent to show cause why the statement should not be accepted.
The show cause notice must specify the date by which the proponent may show cause.
The date specified in the show cause notice must be not less than 10 business days after the date of the notice.
The Minister must consider any response given by the proponent to the show cause notice in making a decision under section 76.
