20 Acceptance of and payment for empty permitted containers by CDS coordinator

(1)

This section applies if:

(a) the operator of an approved collection depot delivers to a CDS coordinator empty permitted containers of any beverage products:

(i) that have been sorted by material type, regardless of the product names displayed on the containers; and

(ii) for which the operator has paid a refund amount under section 19(1); and

(b) there is an operator arrangement between the operator and coordinator in relation to permitted containers; and

(c) the operator claims from the coordinator a refund amount for the containers and other amounts payable in accordance with the operator arrangement (related amounts).

(2) The CDS coordinator must accept the permitted containers unless any of the following circumstances apply:

(a)

the coordinator is unable:

(i)

to identify the container as being a permitted container; or

(ii) to be satisfied the container was purchased in the Territory, or a corresponding jurisdiction, after the start of the CDS;

(b)

the container is contaminated.

(3) However, the CDS coordinator must not refuse to accept a container in a circumstance mentioned in subsection (2)(a) or (b) if the operator arrangement requires acceptance in that circumstance.

(4) The CDS coordinator must pay the operator the refund amount and related amounts in accordance with the operator arrangement.
