Evidence Regulations 2012

These Regulations may be cited as the Evidence Regulations 2012.

These Regulations commence:

if these Regulations are notified in the Gazette before the commencement of the Evidence (National Uniform Legislation) Act 2012 - on the commencement of that Act; or

otherwise - from the date these Regulations are notified in the Gazette.

For the definition reporting scientist in section 24 of the Act, each of the following is a prescribed qualification:

a degree of Bachelor of Molecular Biology awarded by a university in Australia or New Zealand;

a degree equivalent to a degree mentioned in paragraph (a);

another science degree that, combined with at least 6 months experience as a forensic scientist at a laboratory, is equivalent to a degree mentioned in paragraph (a) or (b).

For section 50(3)(a) of the Act, each of the following is an appropriate judicial authority:

the Supreme Court of a State or another Territory;

the District Court of New South Wales, Queensland or South Australia;

the County Court of Victoria;

the Local Court of New South Wales;

the Magistrates Court of Queensland, South Australia or the Australian Capital Territory.

The Regulations specified in the Schedule are repealed.
