14 Consideration of applications received on same day
This section applies if:
the Agency receives, on the same business day, 2 or more applications for the grant of a geothermal exploration permit; and
the Minister is satisfied each application area is substantially the same; and
each applicant has met the requirements for the application specified in section 35.
The Minister must decide which application has the greatest merit to be given consideration for the grant of a permit.
An application for the grant of a permit received by the Agency after 4 pm on a business day is taken to have been received on the next business day.
Note
Section 112(2) has the effect that the Minister need not consider an application under this section if a fee prescribed for making the application has not been paid.
