95 Environmental nuisance – negligence
(1)
A person commits an offence if:
(a)
the person engages in conduct in a geothermal authority area; and
(b)
the conduct contravenes an environmental obligation; and
(c)
the conduct results in environmental nuisance.
Fault elements:
The person:
(a)
intentionally engages in the conduct; and
(b) is negligent about whether the conduct will result in environmental nuisance.
(2) An offence against subsection (1) is an environmental offence level 4.
