28 Application of Division
(1)
This Division applies if, under Division 3, the Council decides not to recommend that the Minister declare a place or object to be a heritage place or object.
(2)
However, this Division does not apply if the Council cannot, under section 41, make an assessment of the heritage significance of the place or object.
