40 Order on committal for trial
(1)
On the committal for trial of a person for an offence with respect to kava that the Court has not ordered to be forfeited and destroyed, the Court must make an order that the kava is to be retained or that the kava is forfeited to the Territory and is to be destroyed.
(2)
Where the Court orders that the kava is to be retained, the
Court must give reasons for making the order.
