28 Protection of insurer
(1)
Notwithstanding anything in this Part, a payment made by an insurer under the contract of insurance without actual notice of the existence of a charge under this Part is, to the extent of that payment, a valid discharge to the insurer.
(2)
An insurer is not liable under this Part for any greater sum than that fixed by the contract of insurance between himself and the insured.
