13.01 When defendant may join third party

Where a defendant claims against a person not already a party to the proceedings (in this Part called a third party):

(a)

a contribution or indemnity;

(b) a relief or remedy relating to or connected with the original subject matter of the proceedings and substantially the same as some relief or remedy claimed by the plaintiff; or

(c) that a question relating to or connected with the original subject matter of the proceedings should be determined not only between the plaintiff and the defendant but also between either or both of them and the third party,

the defendant may join the third party as a party to the proceedings.
