17.07 Failure to answer

(1)

If a plaintiff or other party claiming relief fails to answer interrogatories, the Court may strike out the claim.

(2)

If a defendant or other party against whom relief is claimed fails to answer interrogatories, the Court may make an order permitting the party claiming relief to proceed as if a notice of defence had not been filed.

(3)

An application for an order under this rule is to be filed and served not later than 28 days before the date fixed for hearing of the proceedings.
