20.14 Withdrawal by defendant

(1)

Subject to subrule (2), and with the leave of the Court, a defendant may withdraw the whole or a part of the money he or she paid into the Court under this Division.

(2)

A defendant is not entitled to withdraw money after the money is accepted by the plaintiff.

(3)

A withdrawal under subrule (1) is to be made by filing a notice of withdrawal of deposit in accordance with Form 20B.

(4)

On the filing of a notice of withdrawal of deposit, the defendant is entitled to receive payment of the money withdrawn.

(5)

A notice of withdrawal of deposit is to be served on the plaintiff immediately after the notice is filed.
