Part 34Assessment of damages or value of goods
34.03 Manner of assessment
(1) Subject to subrule (3), damages are to be assessed by a judicial registrar unless the Court orders otherwise.
(2) The party against whom an order for the assessment of damages is made may take part in the assessment.
(3)
Where:
(a) the Court makes an order in proceedings against some defendants for default judgment with damages to be assessed; and
(b)
the proceedings are continued against other defendants,
the damages are to be assessed at the hearing of the proceedings unless the Court orders otherwise.
