r 5.02

Objection to venue

In force

(1)

Subject to subrule (2), where:

(a) a defendant objects that the Court venue from which process is issued is not a proper venue for the proceedings; and

(b) the Court is satisfied, having regard to the convenience of the parties, that the proceedings should be transferred;

the Court may adjourn the proceedings to another Court venue.

(2) The defendant must give notice of the objection to the plaintiff with the notice of defence unless the Court orders otherwise.
