8.05 Conditional defence
(1)
Where a defendant claims that the Court does not have jurisdiction to hear the proceedings, the defendant may apply to have the proceedings stayed or the statement of claim set aside.
(2)
An application under subrule (1) is made by filing a conditional notice of defence in accordance with Form 8B.
(3)
A conditional notice of defence has effect as an unconditional notice of defence unless the Court orders otherwise.
