88 Contravention of Part 4, Division 6
(1)
A returning officer for an election commits an offence if:
(a)
the returning officer engages in conduct; and
(b) the conduct results in the election being determined or declared otherwise than in accordance with Part 4, Division 6; and
(c)
the returning officer is reckless in relation to that result.
Maximum penalty: 100 penalty units.
(2) An offence against subregulation (1) does not apply to the Electoral Commissioner.
