Failure to help authorised officer other than in emergency
74 Failure to help authorised officer other than in emergency
If an authorised officer (other than an officer taking action under section 70) requires a person under section 62(1)(h) to give reasonable help to the officer in relation to the exercise of a power specified under section 62(1)(a) to (g) (inclusive), the person must comply with the requirement, unless he or she has a reasonable excuse.
Maximum penalty: 500 penalty units.
If the help required is the answering of a question or producing of a document (other than a document required to be held, kept or produced by the person under this Act), it is a reasonable excuse for the person to fail to answer the question, or produce the document, if complying with the requirement might tend to incriminate the person.
