89 Appeals
(1) A person whose interests are affected by a decision under section 88 may appeal to:
(a) if the amount the Chief Executive Officer seeks to claim or realise is an amount not more than the amount of the monetary limit that could be recovered for a debt under the Local Court Act 2015 – the Local Court; or
(b)
in any other case – the Supreme Court.
(2) An appeal is to be by way of a rehearing but a party to an appeal may present new evidence at the appeal hearing.
(3)
Costs of the appeal lie in the court's discretion.
