36 Delegation
The Board and, subject to the directions of the Board, the
Director may, by instrument in writing, delegate to a person any of its or his powers and functions under this Act, other than this power of delegation and, in the case of the Board, the power to make Rules under section 42.
A power or function delegated under this section, when exercised or performed by the delegate, shall, for the purposes of this Act, be deemed to have been exercised or performed by the Board or the
Director, as the case may be.
A delegation under this section does not prevent the exercise of a power or the performance of a function by the Board or the
Director.
Where a power or function is delegated under this section by the
Board to a member of the staff of the School, that power or function shall be deemed to have been delegated to the Director also.
