Benefits for attendant care services are payable under this section to or for the benefit of an eligible person if:
the eligible person suffers a permanent impairment as a result of the injury received in, or as a result of, the motor accident; and
the degree of the permanent impairment is assessed by the
Commission at 60% or more; and
the person requires attendant care services in consequence of the impairment.
However, benefits are only payable under this section if the services are of a standard the Commission considers appropriate.
Benefits payable under this section are to be determined in accordance with the regulations.
The relevant limit for each week is 32 hours less the number of hours for which the eligible person receives nursing care in that week.
