28 Representations by owners of land on which site situated

(1)

Before registering a sacred site as the result of an application under section 27(1) the

Authority shall give to each owner of land comprised in the site or on which the site is situated a notice:

(a)

giving details of the area concerned;

(b)

inviting the owner to make written representations in connection with the application by a specified date, being not earlier than 28 days after the receipt of the notice; and

(c)

specifying an address to which such representations may be sent.

(2)

The Authority shall give due consideration to all representations made by an owner as the result of an invitation under subsection (1)(b) and in particular shall make and record its findings in relation to the immediate or possible detrimental effect, if any, the fact that the site is a sacred site may have on the owner's proprietary interest in the land.

(3)

Where the owner of land to whom a notice under subsection (1) has been given advises the

Authority that the owner's intended work on or use of the land may be constrained by the existence of the sacred site, the Authority shall advise the owner, in writing, of the owner's right to apply for an

Authority Certificate in relation to the land.
